1. Overview
These Terms of Service govern your use of chefhartung.com and any services booked or purchased through this website or direct communication with Chef Charles Hartung. By accessing this site or engaging Chef Charles's services, you agree to be bound by these terms in their entirety. If you do not agree to these terms, please do not use this website or engage Chef Charles's services.

Chef Charles Hartung offers the following services:

All services are subject to availability and are confirmed only upon receipt of payment or written confirmation from Chef Charles directly.
3. Bookings & Confirmations
Inquiries submitted through the website do not constitute a confirmed booking. A booking is confirmed only when:

Chef Charles has responded directly confirming availability

Payment has been received in full, or terms have been agreed upon in writing
Chef Charles reserves the right to decline any inquiry or booking at his sole discretion without obligation to provide a reason.
4. Payments
Payment for services is due as outlined at the time of booking confirmation. For bespoke or custom engagements, payment terms will be agreed upon in writing prior to the engagement beginning.
All prices are listed in US dollars. We reserve the right to adjust pricing at any time. Any price changes will not affect bookings that have already been confirmed and paid in full.
5. Cancellation & Rescheduling Policy
All bookings and service engagements with Chef Charles Hartung are considered final upon confirmation. Cancellations of any kind — regardless of timing or circumstance — do not qualify for a refund.
Rescheduling requests are accommodated at Chef Charles's sole discretion and are subject to availability. Rescheduling does not constitute a cancellation and will be handled on a case-by-case basis. To request a reschedule, contact Chef Charles directly at Chef@GulfHarbour.Com as early as possible.
6. Refund Policy
All sales and service bookings are final. Chef Charles Hartung does not offer refunds under any circumstances, including but not limited to:

Client cancellation for any reason

Scheduling conflicts or changes in availability

Dissatisfaction with services rendered

Force majeure or unforeseen events
By submitting payment or confirming a booking, the client acknowledges and agrees that all charges are non-refundable. If you have questions about a service before booking, we encourage you to reach out directly before completing your purchase.
7. Client Responsibilities
For in-home dining, private culinary experiences, and on-site consulting engagements, the client agrees to:

Provide a safe, clean, and adequately equipped environment

Disclose all dietary restrictions, allergies, and food preferences prior to the engagement

Ensure reasonable access to the property or facility at the agreed-upon time

Provide accurate and complete information regarding the scope of any consulting engagement

Treat Chef Charles and any accompanying staff with professional respect at all times
Chef Charles reserves the right to terminate a service without refund if the environment is deemed unsafe, if accurate information was withheld, or if the client acts in an inappropriate or disrespectful manner.
8. Dietary & Allergen Disclaimer
Chef Charles takes all dietary restrictions and allergen information provided by the client seriously and makes every reasonable effort to accommodate them. However, it is the client's sole responsibility to disclose all relevant dietary needs prior to the engagement.
Chef Charles Hartung cannot be held liable for reactions, injuries, or issues arising from information that was not disclosed prior to the engagement. Cross-contamination risks exist in any kitchen environment. Clients with severe allergies or medical dietary requirements should discuss this directly with Chef Charles before confirming a booking.
9. Intellectual Property
All content on this website — including copy, photography, menus, recipes, branding, and design — is the intellectual property of Chef Charles Hartung and may not be reproduced, distributed, or used without explicit written permission.
Menu concepts, recipes, culinary frameworks, and program strategies developed during a consulting or coaching engagement remain the intellectual property of Chef Charles Hartung unless a separate written agreement specifically transferring ownership has been fully executed by both parties prior to the engagement.
10. Confidentiality
Chef Charles Hartung treats all client information, club operations data, financial details, and engagement specifics with strict confidentiality. Information shared during a consulting or coaching engagement will not be disclosed to any third party without the client's explicit written consent, except where required by law.
Clients are similarly expected to treat any proprietary methodologies, frameworks, or strategic information shared by Chef Charles during an engagement as confidential and not for redistribution or resale.
11. Limitation of Liability
Chef Charles Hartung's total liability for any claim arising from services rendered is limited to the total amount paid for the specific service engagement in question. Chef Charles Hartung is not liable for any indirect, incidental, consequential, punitive, or special damages of any kind, including but not limited to lost profits, lost revenue, or reputational damage, arising from or related to the use of his services.
12. Disclaimer of Warranties
Services are provided on an "as is" basis. Chef Charles Hartung makes no guarantees regarding specific outcomes, financial results, membership satisfaction levels, or operational performance improvements resulting from any consulting, coaching, or culinary engagement. Results will vary based on client circumstances, cooperation, and implementation.
13. Governing Law
These Terms of Service are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved exclusively in the courts of Lee County, Florida. By engaging Chef Charles's services, you consent to the personal jurisdiction of such courts.
14. Entire Agreement
These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Chef Charles Hartung with respect to your use of this website and engagement of his services. They supersede all prior communications, representations, or agreements, whether written or oral.
15. Changes to These Terms
Chef Charles Hartung reserves the right to update these Terms of Service at any time without prior notice. Updated terms will be posted on this page with a revised date at the top.
